In my post of last night, I made the following comment:
"I am open to other interpretations of the document below, but counsel for Cliffs asked to have "evidence of settlement discussions" struck from KWG submission to the Commission and the Commission agreed (see Order 1). Now why would that be? They are asking that this evidence not be used by tribunal and be sealed from the public record until AFTER a decision is made by the tribunal....hmmmm. Cliffs is trying to have other portions of KWG's submission sealed from the public record as well (see Order 2)."
In my haste to get this info out to my fellow shareholders, my comment re: Order #1 is unclear and even incorrect. Cliffs has asked that "evidence of settlement discussions" not be admissable to the hearings but an order to grant this exclusion has not been granted by the Commissioner - it is pending a preliminary moton (undecided at this stage). Re: Order #2, it is correct that Cliffs is trying to have certian portions of KWG's evidence/submission excluded from the hearing and public.
Sorry for any confusion I may have caused. With all these challenges around simply the info to be looked at, I can understand why this will likely be tied up for months.
