I would like to share with my fellow shareholders what I know of the hearings that have transpired over the last 2 days.
As I mentioned in earlier posts, I was not able to attend the hearing on Thursday but spoke to a few that were in attendance and wanted to share with you what I know. As well, I was in attendance today and wanted to share my observations.
Recall Thursday's hearing was about whether the FN group could be added as a party to the hearing of the easement issue. According to those in attendance on Thursday, it was very well attended especially by FNs and interested parties associated with KWG. The hearing went the entire day and the submissions concluded which means it is now in the hands of the Commissioner. We can expect a decision within the next 60 days is my understanding. From a few casual conversations and opinions, I gathered that the FN submission was strong and there is a good chance they will be added as a party to the proceedings. All up to the Commissioner now!
Today's hearing was more contentious. The issue before the Commissioner was whether portions of KWG's submission could be excluded from the proceedings. Cliffs filed a motion to have certain portions of KWG's submission/evidence to the Commissioner removed while KWG was arguing to keep them in as part of their argument. Please see my earlier post that included the actual document from the MNR that described the issue in more detail. In the end, the Commissioner decided that KWG's submission/evidence would be admissible to the proceedings but would be sealed from the public record - at that point, all those in the public gallery were asked to leave and the proceedings continued. We'll never know! The proceedings are continuing this afternoon but I unfortunately cannot be attendance due to the sealing of the evidence. I will resume attending upon notification from the MNR that the proceedings are again open to the public. One person from the MNR indicated to me that this was an abnormally complex case and would not be resolved for some time...get comfy folks!
As an aside, between breaks and other logistical processes I was able to meet and observe several people representing the MNR and the Commissioner's office. They are the nicest and most intelligent people you'd ever meet. As well, Frank's selection of legal counsel is top notch - skilful, articulate, nimble, agile - I've met many many lawyers and these guys are focused and determined. We're in good hands.
