Aagene is using falsehoods, misconstruances of the Mining Act, to justify Cliffs corporate strategy of gaining a monopoly over all ROF chromite deposits through control of a constrained and singular product distribution channel. Cliffs is counting on the naivety of the public to grasp intricate distinctions within certain points of law. The mining tribunal was not fooled.

It's one thing to be granted easement to cross a small portion of a mining claim with little or no detriment to the claim holder. It's another thing for the Crown to expropriate a significant portion of a minority joint-venturer's contiguous ore transport right of way, to prefer the exclusive interests of the majority joint-venturer, effectively rendering previously agreed to mine development agreements void and null.

There is one small break left in KWG's contiguious railways claims, apart from the Noront mine area. A right of way is necessary over a small portion of a mining claim belonging to Discovery & Northern Shield. Unlike Cliffs, KWG, when the time is right, will work toward an amicable solution with these claim holders, one of mutual benefit, rather than threating expropriation or easement.
