Deputy, the hearing today is not the actual appeal, but to decide if the Attorney General can intervene (?). The appeal will be sometime in June, with or without the Attorney General.
I think they want to clarify the point that the easement might have been granted if it were shown to be in the public interest to override KWG's interest. In other words, CLF wanted a private road, and was refused an easement, but if the province wants to build a road or railway on those claims - a public transport of some sort - they could get an easement.
