IMHO, it seems to me, that EPA is slightly disappointed, that either Mr. Loda (BLM) or/and  LAC have omitted EPAs recommendations. I do not know if EPA has any “veto” over ROD. It looks like it has not (“…The EPA has served as a cooperating agency…”) and EPA just has expressed a disapproval, washed its hands and move responsibility to BLM.

Overall, I would say, EPA lets it go. But it is also possible, that it is just a polite government newspeak and in the letter they have just re-stated 2 block, they do not want to give up and will let the matter go, should BLM complies with requirements.

However, considering recent market development,  it is more than conclusive, that LAC is on its way to get the approval.
