By the time this case is heard in December (decision in January), this is where we will likely be:

1.       Nevada (NDEP) Water Permit - issued, with conditions (limiting mining above water table, monitoring and mitigation plan)

2.       Nevada (NDEP) Air Permit – issued, with conditions (monitoring and mitigation plan)

3.       Nevada (NDEP) Reclamation Permit – issued, with agreed bond amount

4.       Sage Grouse – mitigation plan agreed with DCNR SETT, (with Conservation Credit System amounts quantified)

5.       Archaeological Survey – completed, with no bones found

6.       Tribes’ claims re Section 106 consultation – already destroyed.

The risk of an adverse finding (on a technical issue) is greater than zero, but diminishing over time, IMO.
