NOTICE OF PROPOSED ACTION – Bureau of Mining Regulation and Reclamation Web Posting: 10/28/2021 Deadline for Comments: 12/01/2021 The Administrator of the Division of Environmental Protection (NDEP) gives notice that an application for a new Water Pollution Control Permit for the Thacker Pass Project, a mining and beneficiation facility, has been properly filed with NDEP in Carson City.

The Applicant for Water Pollution Control Permit NEV2020104 (Permit) is: Lithium Nevada Corp. 5310 Kietzke Lane, Suite 200 Reno, NV 89511 The facility is located on public land in Humboldt County, within Sections 1 and 2, T44N, R34E; Sections 2-17, T44N, R35E; and Sections 7, 8, 14-23, and 29, T44N, R36E, MDB&M, approximately 18 miles northwest of the town of Orovada. The Project consists of an open pit mining and chemical processing facility, pursuant to Nevada Administrative Code (NAC) 445A.394.

The Administrator is constrained to either issue the Permit or deny the application. The Administrator has made the tentative decision to issue the new Permit. Pursuant to NAC 445A.404, the Director is providing this notice of a Public Hearing on the proposed action.
