Thanks for posting, ElithX.  Will and Max will continue their efforts until all legal remidies for them have been exhausted and then comes the extra legal "Phase II" portion of their plan.

I suspect that they know ahead of time they will eventually have to go into that area of extra legal activity and that Will's legal fencing and dancing theatrics are but a delay to give them time to marshal together all possible resources for "Phase II" once they fail in court. 

It's not over till its over.
