And our "good friend" the Center for Biological Diversity is now dancing in the streets, at least temporarily.

  Every LAC owner should take a good hard look at the article Clifford is referring.  CBD has a partner on this attack and it is the Fallon Paiute-Shoshone Tribe.

  Although both of these plaintiffs failed in their bid to stop the construction on Ormat's Nevada geothermal plant 100 miles East of Reno in a decison by the U.S. 9th Circuit Court of Appeals on Monday, 1 Autust 2022, it appears that only hours after Monday decision by the court " lawyers for Ormat, the government, environmentalists and the tribe filed a joint stipulation in federal court in Reno outlining a voluntary agreement to suspend construction for at least 30 days — and perhaps until the end of the year."

Strange that Ormat Technologies has no mention of this capitulation, temporary or otherwise, to CBD and the Fallon Paiute-Shoshone Tribe on their "News" internet site:

Ormat is scheduled to announce Q2 Earnings to their investors on a Conferrence Call on Thursday, 4 August 2022.  Should be quite an interesting conference call.  Might be more "heat" in that conference call than in the bottom of one of the geothermal plants that Ormat has around the world, eh?

Is there any similarity between Ormat's situation and the situation out at Thacker Pass for LAC?  I think that might just be Clifford's concern in posting a link to this article, if not then it sure is a concern for me.  Why would Ormat win at the 9th U.S. Circuit Court of Appeals in the toad war with the plaintiffs and then concede delay on construction of the geothermal plant at Dixie Meadows in Nevada?  Why indeed!!!!

"The unusual turn of events comes after the U.S. Fish and Wildlife Service took the rare step of declaring the Dixie Valley toad endangered on a temporary emergency basis in April — something the agency has done only one other time in 20 years."

"The new agreement filed Monday acknowledges that the formal consultation must be completed so any risks to the toad can be fully evaluated before it suffers any irreparable harm.

Ormat agreed to suspend construction until the wildlife service issues a formal biological opinion following the consultation, or until Dec. 31, whichever comes first. It also agreed to provide 30 days' notice before it would resume any construction.

“This agreement comes just in the nick of time to save this little toad from extinction,” said Patrick Donnelly, Great Basin director for the Center for Biological Diversity. “We support geothermal energy, but it can’t come at the cost of biodiversity.”

The 9th Circuit's panel ruling earlier Monday said that further delay of the project would make it “all but certain” Ormat would be unable to meet a contract deadline to complete construction by the end of this year.

Ormat said failure to meet the deadline would cost the company $30 million over 20 years and could jeopardize the entire project, which was approved by the U.S. Bureau of Land Management in November"

This adds new meaning to the phrase:  "It ain't over till the Fat Lady Sings"  For LAC and Thacker Pass the Fat Lady hasn't begun to sing just yet, so it definitely isn't over.
