As much as I agree with you with respect to the importance of the mine, Judge Du is assessing neither the importance of the mine, or even whether or not the mine will be sufficiently environmentally friendly. In fact, she is assessing exactly if there are sufficient "legal or technical quirks" in the RoD process to grant the appeal, or at least elements of it, and make BLM/LAC jump through some additional specific hurdles before allowing the final RoD to stand.
