You are correct Roy. But I would add that if the Court finds Federal law has been violated (which I doubt), then the issue of remedy must be considered, and it is here that "public interest" becomes relevant. I will be interested to see how much emphasis there is on public interest in the BLM/LAC final arguments, which will be filed tomorrow.
