BUSHleague, agree with your assessment regarding up to what point the Insurers will defend, settle, or follow the policy provision to ``get out`` of paying any additional costs by transfering the remaining risk back to the Insured, (limiting Insurer`s potential exposure to paying out the total policy limit).
On the other hand, as Ron stated to eloquently, some companies, (Insureds) have their own warchests and are looked upon as industry leaders who will not take the settlement route IF they believe they will ultimately prevail in a court, (or appeals courts) of law, no matter what the cost, as in David v. Goliath.
Such matter are always interesting...can`t wait to see the outcome. I wouldn`t want to pull in any chips until a final conclusion is reached.
