Nothing has changed other than the pps. We`re getting closer to a ruling from the Texas court and hopefully closer to more settlements as well. The eBay ruling simply states that judges have FLEXIBILITY in issueing injunctions, and that plaintiffs must meet certain criteria in order to achieve them. This is pretty much a non-issue as far as PTSC is concerned. We are not looking for injunctions, we`re looking for settlements and MercExchange did in fact reach an equitable settlement and got paid. Each and every case is different and we will be judged on our merits which I believe are very strong. Here is the jist of the eBay ruling.
In a closely watched case, the court unanimously ruled that judges have flexibility in deciding whether to issue court orders barring continued use of a technology after juries find a patent violation. The decision threw out a ruling by a federal appeals court that said injunctions should be automatic unless exceptional circumstances applied.
