for all we know the company may have arranged a short term line of credit (with a real financial institution, not a Swartz!) and is presently using that line to repurchase shares. The line would be backed by our share of the Sony fee (or for that matter any fee we are to receive) as collateral and could be quickly paid off when we receive those proceeds. This would still fall under the statement that 10% of future settlements would be used for share buyback but would allow the company to do the buyback at opportune times.
