looks to me, IMHO, that the J3 want a look at settlement agreements. there are provisions in the scheduling order for the production of documents, including any settlements related to this action (which would, it seems, include the fujitsu settlement). such documents also, it appears, can be submitted under a protective order which means they would be kept confidential by the court/between attorneys. meaning the public wouldn`t see them, but the parties to the case could. if i were the J3, i`d want to know the terms others settled on.
