I heard a story today I thought I would share.
Girl`s softball is big in my location. Recently during a local ballgame, a young lady was up to bat and had taken three balls in a row. She looked at the coach who was giving her signals. After he gave the signals, the girl shrugged her shoulders at him. He gave the signals again and she responded as before. He gave the signals more emphatically and again she shrugged. Instead of giving her signals again, he yelled at her saying ``Don`t swing at the next pitch!`` for all to hear. The girl nodded her head and stepped up to the plate. The pitcher pitched the ball right over the plate and the girl jacked it over the fence for a three run homer.
After I heard the story, I thought about Patriot`s situation and how it might relate. With license monies soon to be in hand, they could play a similar game with the J3 and other potential licensees. Instead of buying back shares at the 10% minimum, buy back a much higher percentage, say >70%. Then plaster the buyback all over the newswires. This might send the message to the J3 and other violators that the price of settlement has gone up substantially, plus I suspect that they would likely be able to buy back around 10% of the OS. To me, it`s either win-win or just win, but I don`t really see lose in the equation since I expect more settlements in the near future.
