Higgins testimony is disallowed wouldn`t Patriot still have a valid patent infringement case against INTC for all of the years prior to Moore`s licensing deal with them? Unless that deal is retro-active to the original date of the patent filing they would still be infringement for all those prior years. Am I missing something here?
