badger, Recording of the expense would be determined by the date a settlement was reached, not necessarily when the payment was made. That does not negate your point, however. If they want to show the expense in the next fiscal year they could just stonewall until then. There obviously would not be an announcement until after March 31, so we wouldn't know until then. In fact, if they settled April 1, I'm sure their auditors would have to look at all the circumstances and decide whether the expense should have been recorded in the fiscal year ended March 31.
