I'm still thinking that either a clerk just failed to enclude them amongst the myraid of NEC org titles in the Pacer filing court order signed by the Judge. As I recall, NEC America is listed among the defendents in the above portion. In my mind, when they followed up the list with the "(collectively "NEC")", I take that to mean all inclusive, and would think that IF the true intent was to specifically leave out NEC America, they definitely would leave out this parenthetical (as they had listed all the effected entities). Just my logical mind at work, and "wordsmith" experience as a contracts guy.

Add to that the just plain weirdness IF part of a Corporation (ultimately one umbrella) held out while the rest of the Corp. settled - how would THAT look in court/to a jury? I suppose it could be that some patents apply here and not there type of thing. But really, it defies logic.

But it is logical that I KNOW nuttin'!
