I agree that a favorable court decision should help PTSC’s income and stock price. But there is no such thing as an ironclad court affirmation. It’s possible that on the day after a favorable court decision some small company comes forward with documented proof that they were using these patented ideas before the patent applications were filed. There are some 400 companies being asked to pony up for patent licenses. Some of these companies may rely on secrecy (trade secrets) rather than public patens. If pressed these companies will divulge their prior use secrets, there’s no reason not to. Prior use trumps a patent regardless of prior court decisions. I think this is unlikely to happen, but it’s a real possibility.
