This has been touched on several times, but not fully addressed IMO. Here I'm talking the current litigation with the J2.5/Arm.
My feel is that while a court win may place us in a somewhat stronger negotiating position, it could take another year (and beyond). And I'm not really sure if it would give us that much more negotiating power. I'm thinking it would depend on the size of the ultimate award.
A settlement could happen at any time and, IMO, anything sooner is better (remove the risk). If the settlement amount(s) were large enough, it may provide the same negotiating "clout" as a court win.
These thoughts just to prompt discussion, if anyone's interested. BTW, I do believe that IF an all-up settlement happened, and the dollars were large, PTSC would be compelled to announce the agregate number to bolster the PPS and influence future settlements.
