Many are of the notion that potential licencees might be holding off until the Markman puts things in perspective. Might they have only been waiting for the filing of construction briefs for their legal staff to get a clearer picture of the strengths and weaknesses of plaintiff and defendant? Other than the presentation in the courtroom, which I know can be extremely important....are not these filings enough for their experts to gauge which side has the momentum going forward?
