And on a serious note: This company is going no where if the litigation is not successful. So we shouldn't ,and they probably aren't too, concerned about the make-up of the board at this point in time.

Probably another good reason for them to schedule the SHM before the Markman. Get all their options in line before the big pop. They have nothing else to do except sit around and think of these kind of things to do at this stage.
