I wouldn't sweat Gafford's testimony just yet. When you compare the two, Gafford v Despain, I see a paid expert witness, Gafford, v. Despain, the founder of Acorn Technology which is now ARM (yes he gets paid, but he is like the god father of microprocessors). Of course nothing is for sure, but I would be nervous if the opposite was true, that being we were relying on Gafford and they had Despain.
