Next question was on how judges handle Markman hearings
Judge Ward says he likes to get tutorials on CD-ROM about a week ahead of time (he sometimes uses technical advisers as well) and gives time limits. He lets the parties use the time however they want, including calling experts, although he notes he's never cited what an expert says. He does find them helpful in means plus function where he is trying to identify the structure. He's never limited the number of terms presented at a Markman ruling. (The amount of time tends to limit the number of claims argued, he says).
