Fairchild Semiconductor Files Patent Infringement Lawsuit Against Alpha & Omega

San Francisco -

SAN FRANCISCO -- Fairchild Semiconductor (NYSE: FCS) announced today that it has filed a patent infringement lawsuit against Taiwan-based Alpha & Omega Semiconductor, Ltd. (AOS).

Fairchild alleges that AOS power transistor products infringe at least four Fairchild U.S. patents, including Nos. 6,429,481; 6,521,497; 6,710,406; and 6,828,195. Fairchild seeks money damages as well as an injunction preventing AOS from selling or importing infringing AOS products into the United States.

Fairchild initiated discussions with AOS in 2005 and since then has attempted to negotiate a license to the Fairchild patents at issue.
In a press release dated May 18, AOS said it had filed a complaint alleging that Fairchild's products infringed patents purchased by AOS. Fairchild has not been served with that complaint. Fairchild has reviewed the patents listed in the AOS press release and believes those patents are either invalid or not infringed by Fairchild's products.

“AOS has chosen to take this dispute to the courts and we have no choice but to respond in kind,” said Izak Bencuya, executive vice president and general manager for Fairchild’s Functional Power Group. “We intend to enforce our intellectual property rights, preferably through negotiated license agreements, and if necessary through the courts.”

Special Note on Forward-Looking Statements:
This press release contains forward-looking statements that are based on management's assumptions and expectations and that involve risk and uncertainty. Forward-looking statements usually, but do not always, contain forward-looking terminology such as “we believe,” “we expect,” or “we anticipate,” or refer to management's expectations about the future performance of Fairchild Semiconductor or the industries and markets we serve. Many factors could cause actual results to differ materially from those expressed in forward-looking statements. Although we believe we have noninfringement and/or invalidity defenses to the AOS patents asserted against us, the results of litigation are difficult to predict and no assurances can be given that Fairchild will ultimately prevail in that case or the case we are asserting against AOS. Our intellectual property and other risk factors are discussed in the company's quarterly and annual reports filed with the Securities and Exchange Commission (SEC) and available at the Investor Relations section of Fairchild Semiconductor's web site at investor.fairchildsemi.com or the SEC's web site at www.sec.gov.
