As a general rule that is correct. However, given the emphasis by the Leckrones on "selling potential customers", (defendants in the law suit), the product, (i.e. the license to MMP), I got the distinct impression during the SHM that there will be an emphasis on settlement by the Mac Leckrone team... 

There was also the point made that some of the 80+ defendants who are in various stages of discussion with TPL were waiting for the Markman decision to decide the size of the check they would write...
