I was thinking the same thing after posting that. Assuming that part of their motivation for dumping/converting was to hedge their bet on the Markman, it would appear that THAT motivation may be gone. AAAHH - no resistance!

I'm still anxious to get Ron's opinion on the next TPL move. Does the '148 knock-out justify our team to file for summary judgment? Would the Judge rule on one patent and allow the remaining to go to mediation/trial? I think the answers are yes and yes.

And I definitely expect Daddy Ron to enjoy his day - this stuff can wait. Heck, we might get the REAL answers before he has a chance to respond!
