It occurred to me this morning that when Judge Ward asked for Fujitsu representation at the Markman, there was a purpose behind it. That would be to establish the fact that Fujitsu had settled in the Markman record, as well as (perhaps) to "dig" alittle at the remaining defendants.
Why would I think this? Does anyone here really think that Judge Ward, who subsequent to this appeared extremely astute regarding everything in this case, actually was clueless about Fujitsu? Would the Judge have a reason to try and make the participants think he was out to lunch/not up to speed at the outset of the Markman?
Just a thought....FWIW. And I KNOW nuttin'!
