As Ronran has advised (as well as others), when a motion for summary judgment is granted, and specifies a "winner", the case goes to a jury purely for the determination of damages (assuming the "winner" is the plaintiff).  Once determined, under certain circumstances, the Judge may go a step further and grant "treble damages" - triple the amount awarded by the jury.
