The
Plaintiffs and Toshiba Defendants have agreed to such dismissal in the Stipulation of Dismissal
previously filed in this matter, attached as Exhibit A, with all rights of appeal waived, and with
each party bearing its own costs and attorney’s fees incurred herein.
