The post to which this replies (Thanks FS!) identifies the chips cited in today's (late?) motion, as well as a slew of other Toshiba products/chips.

What I'm thinking is that perhaps all these other chips/products are NOT based on ARM designs, but other suppliers or in-house designs.

Now, assuming Toshiba included Patent Indimnification clauses in ALL their contracts for those ARM-based chips, Toshiba is off the hook for those (while ARM remains on the hook).  So Toshiba, in essence, is only on the hook for these other products/chips that didn't come from ARM.

All that said, it makes sense to me that the parties (TPL/PTSC and Toshiba) would want to "clean things up" for a settlement, just to make it clear that they (Toshiba) would only be settling for chips that did not come from ARM (again, to make it clear to the court that those chips are ARM's problem, not Toshiba's).

Assuming this is correct, the decks are now cleared for a Toshiba settlement of all remaining liabilities, with a now-simplified filing with the court to advise of same.

But I KNOW nuttin' - pure speculation.  And it wouldn't matter if this motion was initiated pre-Markman; it's all for clarification for the court in anticipation of a possible post-Markman settlement.  But it is interesting that it hits at this late date - implying what I am speculating.
