The case before Judge WARD is set for trial sometime this fall. And it is highly unlikely USPTO will have any ruling on relevant issues before them by then. Even if they do, and assuming it is contrary to the MARKMAN RULINGS, IT WOULD not have any effect on the Court's Rulings, save perhaps being raised on appeal by defendants...

USPTO and PUBPAT are, at this stage of the game, a mere flea on the rear end of the MARKMAN HORSE TPL and PTSC are riding to the finishing line this fall...
