After re-thinking all of this, the only logical conclusion that I can come to, and since the inventorship case should be a dead issue since it was settled, is that the original patent application paper work maybe is being scrutinized for authenticity due to ownership . If fish is listed as an inventor and in fact he wasn't then they could possible invalid the patent.
