is the fact that even if one claim is "rejected" in a patent that has 29 or more claims, for example, the other 28 claims are still "enforceable" AND the Patent holder has the right to amend it's patents with additional sources/proof at the time of the reexam, "if necessary" and Without the 3rd Party who initiated the reexam having ANY SAY.
Remember that a "re-exam" is granted over 90% of the time. So this is a very common occurance with the USPTO.
This is our chance for a "do-over" with the PTO and I am hopeful that are patents will be overwhelmingly validated........as they were in the Markman.
