This is quite true, but if you read the 148 claim and compare it to the two claim constructions, it is obvious to me that the two parties are trying to get more or less than what is actually claimed. This is probably true on all the constructions. TPL is not going to constrain itself in the interpetation if there is a chance they can get more than what was originally claimed. The oppoistion will do likewise. So while on the surface it looks like defendants may have won this terms construction, in all liklihood it is what TPL expectd. All IMHO Opty
