PTSC/TPL argued that an engineer could increase the substrate area in an attempt to bypass infringement

Ward countered ( my interpretation) that while this could happen theoretically it

could not happen practicall since the economics would not make sense, That is that the cost to increase the

substrate so as to leave an unused area to bypass infringement would be far more expensive

than the cost of a license.

So depending on whether there are relatively large unused portions of the

top surface of the substrate on curretn and prior J2.5 chips will determine

whether this actaully hurts or helps.
