An answer from the ignorant....

Based on the PACERs on this, it's solely between us and MEI it appears. If MEI fell out of the picture (i.e., settled), it would make no difference to the remaining Js - just as ARM dropping out makes no difference, IMO.

When I say no difference, I mean to the ongoing litigation. There would be a big difference in perceptions IMO.

Ron has brought his knowledge to this latest filing. He acknowledges that, in essence, one avenue that would certainly resolve this "issue" would be a settlement. I hesitate to strongly suggest this is what's in the immediate works.

But it does occur to me that IF MEI settled before supplying any further input to the court on this issue (which, as Ron suggests, may be the essence of their defense) and/or before our team supplied its rebuttal, there would be minimal impact to the remaining litigants. Does MEI care? Who knows.

So there's your input from the ignorant, who KNOWs nuttin'!
