IMO No, since they do not meet the 2 criteria for a filing.... they are neither, 1) a >10% holder and 2) a director. Remember they are limited to 9.99% and their control is through Carlton J. who is an employee of Swartz. I believe this was concluded when me and Ba discussed it in the past. I mean how else can Swartz's position decline...it went from 38M to I think 32M and we never saw any filings. I hope they continue to reduce their position down to 0 and I don't really care if it stock price takes a temporary hit. They have done nothing but repeatedly stick their hands in the cookie jar.
