I hope it is an endeavor of which Judge Ward deals. Or it will surely be dealt with on appeal. It is better to just get rid of it now. It should have been dealt with in California to conclusion.
I feel that it is just a nuisance item the J's are throwing around. Their defense will slowly deteriorate as time goes by, perhaps leading to settlement. Unless they have something in the closet, they are doomed.
Another way I look at it, in the ownership disagreement I think PTSC has the upper hand. If in fact they didn't, Fish would never had released his waiver for attorney client privledge, and if Moore was at an advantage, he would have released his. He who is protecting has more to be concerned about. How the J's saw it the other way, I'll never understand. Maybe that is what is in their closet?
