IMO , the latest pacer (thanks wolf) has provided the proof we were seeking; this is they can't claim the are not using our patents , they are good if they stand. Their ploy is to do a end around and try to get the court to say that the patents should have never been granted in the first place.

I can see the trial now.

Nec- we do not infringe

TPL- your products are xy and z and we have proof of a b and c , so your in direct conflict and do ingringe.

Nec- yes i see you point how ever Higgins said Moore said that Fish said that PTSC should have said or did ................(he said , she said) you know.........they should have never been alowed to have the patent in the first place ......So our position is we do no infringe a patent that we believe to not be valid because them a-holes shouldn't own it in the first place.. I mean , surly their is some sort of missing dot on an i or someone forget to cross a t and we can claim non-infringement because surly the MMP patents don't exist.

TPL - dose the clock and ring osillator work as described in our patents.

NEC- well yes, however that is not the issue, the issue is that of leagalised theft, see sense Moore(TPL) and Fish(Nano-PTSC) got into an agruement and tried to gain controll outright of the whole patent portfolio , well something must have messed up in that litigation so we can be given a pass now. I mean ,you know, they screwed themselves and make teh patents invalid......Didn't they?

TPL- We reached an agreement and unified the MMP Patents inorder to move forward to sue theif, you know , you guys.

NEC- Your honor , ARMHY got away with the right/left issue and surely we can find some loopole to get us off too. Can you give us another couple of months to dig into and manufacture some sort of dirt on the legal loopole issue?

Lady's and Gentlemen of the jury, NEC is desprate to prove we hold no patents, I'm at a loss as what to say.....why else would we be here? Our patents are here on desplay , they can't argue or prove they are not using our IP, their other ploys are kind of funny don't you think?
