I disagree for the following reasons:

It is rare for a judge to defer pending motions for the sake of mediation;

Damages in excess of several hundred million dollars to protect patent rights contained in Patent No. 5,809,336 were sought by PTSC. This did not include the '148 patent;

A jury trial opens the way to triple damages in the event of willful infringement;

The USPTO considers current litigation in reaching a decision on patent validity.
