Ooops, I also NEED to say this: IMO, there is no necessity for the Judge to rule on any outstanding motions prior to ruling on a motion for SJ (especially if he considers those outstanding motions as probable BS, or hasn't considered them at all). The bottom line issue, IMO, is "did you infringe and how much is it worth?".
