There is another motion, I think, and that's the one about whether the deadlines for providing certain documents should have been pushed back when the trial date was, or should it have remained the same. Tpl and Toshiba tussled back and forth over this one, and the oncern on the board, as iIrecall, was that one of the dates Toshiba wanted to keep in place was very close to mediation -- and, again if I recall correctly, that date has already passed, without Judge Ward issuing a ruling and, presumably, without TPL squawking further. So that lack of ruling/noise on that motion might appear to suggest that at least something has been worked out vis a vis those dates.
