I am not sure the current litigation still includes the '584..  JT has stated the litigation has been 'streamlined' concentrating on just the '336 & '148.. and this from the latest Pacer..

With regard to the allegations relating to U.S. Patent No. 5,784,584, Plaintiffs aver that no response is required in light of the parties' Stipulation of Partial Judgment and the Court's Order thereon dated September 12, 2007

IMO MSJ for '336 '148 can be requested anytime by TPL.. and it may happen (soon) if Mediation is unsuccessful
