[Other companies got the thing to work ](e.g., Intel), probably before our PTSC guys even even tried.  And if [they did "tweaking"], they apparently didn't patent the tweaks.

Isn't this exactly what the J2.5 are trying to convince the courts of?

We(J2.5) contend the idea didn't work when the patent was submitted to USTPO.  We stole the idea. We teaked it to make it work.  We didn't patent any changes we made.  So - we shouldn't be accused of infringing.... Maybe this is all true but, according to the letter of the law and the patent, they are infringing.  They are SOL!  LOL...
