I have to agree with Bill (though we both may be wrong). Why would they include a reporting requirement for agreed continuation if the report is not due until mediation - after having been continued - was complete? It seems that if this were the intent, the only things possible to report would be settlement or impasse.
I suppose this prompts the question as to whether your contact would be in a position to know whether Judge Ward DID get a report confidentially.
Perhaps a question for you to pose to your contact is "what are the ramifications in instances like this where the Mediator failed to follow court rules?". If they say "no biggy", then we know to just wait it out (which we're going to have to do anyway). But if it's a BFD, then the "confiential report" theory perhaps holds some water (and we have more reason to speculate).
We've probably built a mountain out of a mole hill with this thread. Ultimately, for me, it doesn't matter that much. I'm holding, and have no available reasources with which to add. I'm just trying to get a better handle on an anticipated pay day - this week, this month, this year, or Jan '08.
