As to when mediation concluded, it is at the end of the Court directed time-frame. As no extensions are on file, then it follows that mediation closed on September 27, as per directions and the report was due within 5 days from then.

From the following, select possible combinations:

none, one, or more, settled

none, one, or more, wanted a continuance(although ALL must agree)

none, one, or more, failed to settle

Whatever the combination, in the event of at least one defendant deciding not to settle, it would appear that the mediator could only file an impasse from the 3 given alternatives. Any defendant who wished to settle, or seek a continuance, could do so outwith the directed mediation. Remember, it is the case and not individual defendants that is the basis for the mediation report.
