We also must remember that just because we file for MSJ, it is not a done deal that it would be granted (tho obviously '336 & '148 construction wording is strongly in our favor).. also It is more than likely that J Ward will also have to make a determination on the Defendants own sure to be filed MSJ.. probably requesting nonvalidity of patents (hopefully the Defendants hopes lie in the ACP motion, and it is denied).. but that alone IMO (IKN) would not render the Defendants rudderless...
