I also agree with your idea that mediation will be considered after this. I think Judge Ward did not like being told by J3 to rule on this or else they weren't mediating (total conjecture). This is normally not the mediation process to bring the judge into the picture to get things rolling.

If Judge Ward rules in our favor, this will greatly increase our opportunity in mediation and beyond. This could be the real impetus to settlement. TPL is a great adversary.
